According to the defence team in a speeding prosecution in Cheshire, nearly all UK speed cameras are illegal. Since 1992, the speed cameras have been authorised by the Home Secretary when in fact they should have been authorised by Parliament. This, the defence claims is in breach of the Road traffic Offenders Act 1988 as it was amended in 1991.
It is estimated that up to £600 million of speeding fines may have been incorrectly applied. It is not clear whether this applies to all speed cameras or just certain types. The speed camera in the case in question was a mobile camera mounted in the back of a van.
It is understood that there already over 80 further cases pending where the alleged speeders intend to use this as a grounds for appeal.
The defence was thrown out by Manchester Crown Court but the case may go to appeal.
Police Stop using Vascar.
In separate news, Scottish traffic police have stopped using the Vascar equipment due to fears that it may give incorrect readings caused by the police radio system.
